These Terms of Use (“Terms”) govern the User’s access to and use of PETROFUND’s CV Depository Platform, which connects job seekers and employers in the petroleum sector, with special focus on the mid and upstream sectors of the industry. By accessing or using the Platform, the User agrees to be bound by these Terms.

1. Eligibility Criteria

1.1 Natural Persons

• Must be 18 years and above.
• Must be eligible for employment in terms of Namibian Laws.
• Represent and warrant that you meet the above criteria and that you have the legal capacity to enter into these Terms.

1.2 Juristic Persons

• Must be a duly registered entity.
• Must be an “employer”, including the State and Direct employers as defined in section 1 of the Labour Act 11 (No. 11 of 2007) as amended by Act 2 of 2012.

2. Account Registration

• User must register to access certain features of the platform.
• User undertakes to provide accurate, current, and complete information during registration and to update such information as necessary.
• User is responsible for maintaining the confidentiality of their own account credentials and for all activities that occur under their own account.

3. Use of the Platform

• Job seekers may upload CVs and search for employment opportunities.
• Employers may post job listings and search for potential candidates.
• All Users agree not to use the Platform for any unlawful, fraudulent, or abusive purpose.

4. User Content

• Users retain ownership of any content uploaded, including CVs and job postings.
• By uploading content, Users grant PETROFUND a non-exclusive, worldwide, royalty-free license to use, display, and distribute their content for the purpose of operating the Platform.
• Users are solely responsible for the accuracy, legality, and appropriateness of their content.

5. Prohibited Conduct

User agrees not to:

• Impersonate any person or entity.
• Upload false, misleading, or fraudulent information.
• Violate any applicable laws or regulations.
• Interfere with or disrupt the Platform’s functionality or security.

6. Disclaimer

• The platform is provided on an “as is” and “as available” basis. PETROFUND makes no warranties, express or implied, regarding the accuracy, reliability, completeness or timeliness of any content, CVs, job listings or employer information.
• PETROFUND does not guarantee that job seekers will secure employment or that employers will find suitable candidates through the Platform.
• The Platform may contain links to third-party websites. However, PETROFUND is not responsible for the content, accuracy or practices of any third-party sites.

7. Limitation of Liability

• PETROFUND, its Trustees, Employees, Consultants, Affiliates, Agents, and Licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Platform.
• PETROFUND’s total liability to any User for any claim arising out of or relating to the Platform shall not exceed the amount paid by a User (if any) for accessing or using the Platform in the 12 months preceding the claim.

8. Indemnification

The User agrees to indemnify, defend, and hold harmless PETROFUND, Trustees, Employees, Consultants, Affiliates, Agents, and Licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with User’s:

• Use of the Platform;
• Violation of these Terms of Use;
• Violation of any rights of another, including intellectual property, privacy, or employment laws;
• Content uploaded, submitted, or transmitted through the Platform, including CVs or job postings.

9. Termination

• PETROFUND may suspend or terminate a User’s account at any time for violation of these Terms or for any reason at PETROFUND’s discretion.
• Upon termination, User’s right to use the Platform will immediately cease.

10. Governing Law

• These Terms shall be governed by and construed in accordance with the laws of the Republic of Namibia.
• Any disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of Namibia.

11. Changes to Terms

• PETROFUND reserves the right to modify these Terms at any time.
• Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
